By accessing and using the site, including placing orders of products through the site, you agree that you will be subject to and will comply with these terms and conditions (including our privacy policy); by completing your registration through the site; and using the site to obtain products from us.

Customers cannot use their personal profile for business orders. For business or bulk orders the customer should connect with m/s Fmart Frozen Foods.

  1. General

1.1. www.fmartfrozenfoods.in is a frozen food shopping website where you can browse, select and order products advertised on the site by m/s Fmart Frozen Foods.

1.2. Please read these terms and conditions before accessing or using the site. If you are under 18 years of age, then you must obtain your parent or guardian’s consent before accessing and using the site.

1.3. Your access to and use of the site, including your order of products through the site, is subject to these terms and conditions.

1.4. Our website uses cookies; by using our website or agreeing to these terms and conditions, you consent to our use of cookies in accordance with the terms of our privacy policy.

1.5. We are committed to privacy principles which set clear standards for the collection, access, storage and use of personal information which we obtain as part of our business operations. Our respect for our customer’s right to privacy of their personal information is paramount. We have policies and procedures to ensure that all personal information, no matter how or where it is obtained, is handled sensitively, securely, and in accordance with the privacy principles.

  1. Registration

2.1. You must complete the customer registration process through the site before placing an order for products through fmartfrozenfoods.in.

2.2. You may not have more than one active account, and your account is non- transferable. You may update, edit or terminate your account at any time through the site.

2.3. You must ensure that your login id and password that is used to access the site and the details of your account are kept in a safe and secure manner.

2.4. You must notify us through customer service that there is or has been an unauthorized use of your login id and password or account, or any other security breach relating to your account.

2.5. You must promptly advise us of any changes to your information provided to us as part of the customer registration process.

2.6. You should check the labels on the products before consumption or use.

2.7. If you choose to use a workplace email address for your account or to access the site, then you are solely responsible for ensuring that you comply with the rules, policies or protocols that apply to the use of your email address and your workplace facilities.

  1. Placing an order for products

3.1. You may order products by selecting and submitting your order through the site in accordance with these terms and conditions.

3.2. Any order placed through this site for a product is an offer by you to purchase the particular product for the price notified (including the delivery and other charges and taxes) at the time you place the order.

3.3. We may ask you to provide additional details or require you to confirm your details to enable us to process any orders placed through the site.

3.4. You agree to provide us with current, complete and accurate details when asked to do so by the site.

  1. Delivery, return, cancellation and refund

4.1. We will only deliver products ordered through the site to a location where we provide services. You may receive multiple deliveries for your order depending on, availability of the time slot, the products and the number of items in your order.

4.2. Our Endeavour will be to deliver the products ordered by you within the timeframe provided by us, but these timeframes are indicative only. Delivery times may be delayed due to traffic or other unforeseen circumstances and hence no refund or discount on your order for the late deliveries.

4.3. We may deliver your order using a “contactless delivery service” and will deliver the products to the front door at the relevant address. You must be present at the delivery address to accept a “contactless delivery”.

4.4. If there is no one at the delivery address to receive the order or we cannot access the delivery address, we will endeavour to contact you to reschedule the delivery and it will be at the sole discretion of Fmart Frozen Foods to recalculate the delivery charges.

4.5. The F mart Frozen Foodsreturn policy applies to all purchases of products using the site. if you wish to return the product due to defect in the product:

(a) Return the product to our delivery staff; or

(b) Contact our customer service to make arrangements to return that product.

4.6. You as a customer can cancel an order up to the cut off time of the slot for which you have placed an order by calling our customer service. In such a case we will refund any payments already made by you for the order. If we suspect any fraudulent transaction by any customer or any transaction which defies the terms & conditions of using the website, we at our sole discretion could cancel such orders. We will maintain a negative list of fraudulent transactions and customers, and would deny access to them or cancel any orders placed by them.

4.7. It is the responsibility of the buyer to check the products and tally them with the receipt at the time of delivery. If any product is found defective or damaged at the time of delivery it should be reported immediately. Even if a wrong product gets delivered it should also be immediately reported. Such incidents will be dealt with keeping into consideration the terms and conditions laid down by m/s F mart Frozen Foodsand the action taken will vary from case to case basis and m/s F mart Frozen Foodswill reserve the rights to deal with such cases independently.

4.8. The product should not be damaged or used by the buyer to get the refund. The refund will depend upon the condition in which the product is returned. It will be the sole discretion of m/s Fmart Frozen Foods.

  1. Acceptance or rejection of an order

5.1. We reserve the right to accept or reject your order for any reason, including if the requested product is not available, if there is an error in the price or the product description posted on the site or an error in your order.

5.2. Each order placed for products through the site that we accept results in a separate binding agreement between you and us for the supply of those products. For each order accepted by us, we supply the products in that order to you in accordance with these terms and conditions.

5.3. If we reject an order placed through the site, then we will Endeavour to notify you of that rejection at the time you place the order or within a reasonable time after you submit your order.

  1. Fees and charges

6.1. We will charge you, and you agree to pay, the following fees and charges in relation to an order that we accept (as applicable):

(a) The purchase price of each product that is ordered;

(b) The delivery fee when placing your order as shown on the site.

(c) Any other fees and charges as applicable at the time of placing your order or at the time of delivery.

6.2. All fees and charges identified in these terms and conditions and all prices for the products include gst and taxes where applicable.

6.3. You acknowledge that:

(a) We are not required or obliged to match any prices for any products, including matching any prices for a product that is available through the site at any outlet online or offline (supermarkets).

(b) All pricing displayed on the site may differ depending on the postal code you have selected.

(c) Prices for products change from time to time and we do not provide any notice of these changes. Subject to these terms and conditions, once we have accepted your order, we will not change any prices that apply to the products in that order.

  1. Payment methods

You may pay the fees and charges online using the online payment methods.

You may pay us using the following payment gateways:

  4. Cash on Delivery

If we are unable to successfully process your payment for your order that is accepted by us, then we may notify you of dishonor and cancel your order.

You must not pay, or attempt to pay, for products through any fraudulent or unlawful means.

We will provide you with a receipt at the time of delivery or collection (as applicable) which specifies the total fees and charges for the products in the order.

If there are items missing from your delivery or collection, then you should check the receipt that we provided you to determine the same. If so, then we will provide you with a refund against the missing product. In all circumstances, you may contact customer service on 8169961537 during contact hours within 10.am to 5.pm hours after the delivery or collection time and we will take steps to verify and confirm any such missing items.

  1. General restrictions, copyright and trademark

8.1. You must not:

(a) Use the site for any activities that breach any laws, infringe a third party’s rights or are contrary to any relevant standards or codes.

(b) Use the site in a manner or way, or post to or transmit to or via the site any material, which interferes with other users or our other customers or defames, harasses, threatens, menaces or offends any person or which prevents any other person from using or enjoying the site.

(c) Make fraudulent or speculative enquiries, purchases or requests through the site.

(d) Use another person’s details without their permission or impersonate another person when using the site.

(e) Post or transmit any obscene, indecent, inflammatory or any other material that may give rise to civil or criminal proceedings.

(b) In a manner that will infringe the copyright, trademark, trade secret or intellectual property rights of m/s F mart frozen foods.

8.3. m/s F mart frozen foods expressly reserve all intellectual property rights in all text, programs, products, processes, technology, content and other materials which appear on site.

8.4. The compilation of all contents on this website is the exclusive property of m/s F mart Frozen Foods. The trademarks, logos, and service marks displayed on the website are the property of m/s F mart Frozen Foods and you are not permitted to use the same without the prior written consent of m/s F mart Frozen Foods.

  1. Suspension of account

We may suspend or cancel your account. We reserve the right to refuse service, terminate accounts and/ or remove or edit content if we, acting reasonably, deem that you have acted in breach of these terms and conditions or have used the site in a fraudulent or improper manner. m/sF mart Frozen Foods also reserves the right to otherwise cancel orders.

  1. Indemnity

you agree to defend, indemnify and hold harmless m/s F mart Frozen Foods, its employees, officers, agents and their successors and assigns from and against any and all claims, liabilities, damages, losses, costs and expenses, including attorney’s fees, caused by or arising out of claims based upon your actions or inactions, which may result in any loss or liability to m/s F mart Frozen Foodsor any third party including but not limited to breach of any warranties, representations or undertakings or in relation to the non-fulfillment of any of your obligations under this user agreement or arising out of your violation of any applicable laws, regulations including but not limited to intellectual property rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights. This clause shall survive the expiry or termination of this user agreement.

  1. Severability

If any provisions of these terms are found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these terms unenforceable or invalid as a whole and such provisions shall be deleted without affecting the remaining provisions therein.

  1. Governing law and jurisdiction

This user agreement shall be construed in accordance with the applicable laws of India. The courts at Mumbai shall have exclusive jurisdiction in any proceedings arising out of this agreement. any dispute or difference either in interpretation or otherwise, of any terms of this user agreement between the parties thereto, the same shall be referred to an independent arbitrator who will be appointed by m/s F mart Frozen Foods and his decision shall be final and binding on the parties hereto. The above arbitration shall be in accordance with the arbitration and conciliation act, 1996 as amended from time to time. The arbitration shall be held in Mumbai. The high court of judicature at Mumbai alone shall have the jurisdiction and the laws of India shall apply.
